Employment and Workforce Compliance

We know that, as an employer, you have daily duties and challenges, with employment and compliance being just one of them. But it’s an important one that needs to be executed seamlessly, or it could cost you a lot of money.

There are federal regulations that need to be followed, plus each state has their own set of employment-related laws that business owners need to be aware of.

Here is some of the guidance we can provide you to help stay ahead of it all.

  • Recruiting and hiring practices, including payment of wages law, which in South Carolina mandates that employers that have had at least five employees at any point in the last year must give a written notice of hours and wages, along with other terms, to each new hire.
  • Classifying workers as employees or independent contractors, by considering the different tests that apply under different federal and state employment laws and the potential penalties for misclassifying.
  • Minimum pay and overtime, which South Carolina does not have in law, but there are federal requirements.
  • Harassment and discrimination, prohibited by federal and state laws.
  • Meal and rest breaks, which South Carolina does not have mandated for private employees.
  • Lactation breaks, which follows South Carolina’s Lactation Support Act that dictates that employers must allow employees reasonable and private opportunities to express milk through reasonable paid or unpaid break time in a private place other than a bathroom stall.
  • Termination, which has specific compliance requirements for employers for both voluntary and involuntary terminations.
  • Business closings and layoffs, under the federal WARN Act that imposed notices and other rules for businesses undergoing, large-scale business closings, layoffs, or relocations.
